LONDON (Reuters) - Relatives of British troops killed in the war in Iraq will be able to sue the government for negligence and pursue damages if they can prove factors such as inadequate equipment led to the soldiers' deaths, an appeal court ruled on Friday.
The court said the British Ministry of Defense (MoD) had a duty of care towards its employees, including soldiers on the battlefield, and had to provide them with the right equipment.
It dismissed the ministry's so-called "combat immunity" argument that the MoD could not be held responsible for the decisions of commanders in the heat of battle.
One hundred and seventy-nine British troops lost their lives in Iraq during the 2003 U.S.-led invasion that toppled Iraqi dictator Saddam Hussein and the six years in which they were stationed there afterwards.
Many of the early casualties were inflicted on troops travelling in lightly armored Snatch Land Rover vehicles developed for combating rioters in Northern Ireland, but ineffective against insurgent roadside bombs in Iraq.
The court said the relatives of four soldiers killed between 2003 and 2007 could now pursue claims against the MoD on grounds of negligence.
"My clients are very pleased with the verdict," Shubhaa Srinivasan, a lawyer representing one of the families, told Reuters. "It's good to know that the Court of Appeal accepted our position that the MoD owes a duty of care to provide safe equipment to soldiers when they go to war."
"Today's ruling is really not about second guessing the soldiers and decisions they make on the ground in the heat of battle," she said. "It's all about whether you're properly equipping troops to do what they're meant to do on the battlefield," she said.
But in upholding a June 2011 High Court ruling, the Appeals Court also said relatives of two soldiers could not claim for compensation on the grounds that their human rights had been violated.
Susan Smith, the mother of Phillip Hewett who was killed in Iraq in July 2005, said she was angered by the decision to prohibit claims to be brought on human rights grounds.
"Why is it that the UK is always ramming down your throat about everybody else's human rights but their own soldiers have got none?" she told the BBC. "The battle is something I've got to do to feel that Phillip's loss was worth something."

Even if you don?t watch trashy reality TV, you probably know socialite Taylor Armstrong, from Bravo?s?Real Housewives of Beverly Hills?(RHOBH), survived domestic violence. ?RHOBH has aired episodes involving an intervention with Taylor about her abusive marriage.
I cringe at the thought of people knowing I watch the?Real Housewives. But sadly, I do. Call it feminist research. Or a guilty pleasure. Feminist media critic Jenn Pozner, in her groundbreaking book?Reality Bites Back, argues the detriments of reality TV for its horrifically negative portrayal of women. Many of us might brush it off as a harmless indulgence. But we should question what we?re watching.
Now, I normally wouldn?t even mention the?Real Housewives?except to deride it for its horrifying message to women about materialism and cattiness. But watching?as a domestic violence survivor, I noticed some things that other people might not pick up on. Who says you can?t learn something from watching TV?? Whether or not you saw the show, it raised some common misconceptions about domestic violence that I want to dispel.
Domestic Violence Myths:
1.?Only poor people suffer domestic violence.?Now, I hope to god people realize this isn?t true. But I have a sneaking suspicion that many people still believe this pervasive myth. Domestic violence doesn?t know income, class or socio-economic status. The only reason why it might appear that rich people don?t face abuse is that they often have the money to afford staying at a hotel if they leave their abusive spouse. Those without disposable income might stay at a domestic violence shelter or turn to law enforcement to intercede. Being rich doesn?t inoculate you from domestic violence.?In the U.S., one in four women will face domestic violence in her lifetime. Domestic violence is an insidious crisis that affects us all.
2.?If you can?t see bruises or cuts, there isn?t abuse.?On RHOBH, Camille Grammer told Taylor she?s confused as to whether or not she?s telling the truth about her abusive marriage (getting hit, having her jaw broken) since she has no bruises or cuts (and stays in her marriage?but we?ll get to that myth in a moment). Physical abuse might not be apparent for a couple of reasons. Some sneaky abusers won?t mark your face to conceal abuse from the outside world. Abusers might punch you in the stomach or crack your ribs. Abuse also escalates. What starts off as pushing or shoving can advance to slapping and then punching. But abuse isn?t just physical. Even if no visible signs of abuse exist, violent threats and intimidation constitute abuse too. Abuse can be emotional or psychological. Abusers can control your finances, not allow you to see your friends or family, tell you you?re fat, ugly or worthless. You should never doubt someone when they confide in you about their abuse.
3.?The abuser is SO nice, calm, mellow, _________, s/he can?t possibly be an abuser.?On RHOBH, Adrienne Maloof?s husband said he just couldn?t believe Taylor?s husband abuses her. He?s too nice and calm. Appearances can deceive. Just because someone seems nice or shy, doesn?t mean they aren?t a total douchebag behind closed doors. Facing domestic violence is a horrific experience. We must take domestic violence claims seriously; people do not bring violence on themselves. Abusers are the ones to blame, not the survivors.
4.?If someone says they?re abused, they would never stay with their spouse or significant other. If they do, they must be lying.?The women on RHOBH can?t seem to wrap their heads around why Taylor (or anyone for that matter) would stay in her marriage if it?s abusive. If abuse happens once, why stay? Many people just don?t understand. A violent relationship often exists in a cycle. Things may go well for a while. Then you bicker, arguing turns into fighting, and that?s when physical violence may occur. Next comes the ?hearts and flowers? phase (which Faye Resnick points out on RHOBH). The abusive partner apologizes, professes their love and swears they will never hit again. Then the survivor thinks, ?oh they didn?t really mean it? or ?they were stressed.? The abuser goes out of their way to make amends. Then the cycle begins again.
Many women stay in abusive relationships because they love their partner and truly believe things will change. Others desperately want to leave but can?t as they?re bound by fiscal chains, worried they have nowhere to go and no way to support themselves. Or their partner threatens them by taking away their kids. Or withholds their passport and reporting them to the authorities if they?re an undocumented immigrant. Others stay for they don?t want anyone to know their dark shameful secret. We shouldn?t assume someone?s lying when they say they?ve been abused. We never know what goes on behind closed doors; we never know the private pain someone faces.
5.?If I reason with a person in a domestic violence situation, logic will spur them to leave their abusive relationship.?Ahhh, it?s so easy, just leave! I know that?s what many people think. What people who aren?t domestic violence survivors don?t realize is that it?s not that simple. When you?re being abused, you feel as if you?re losing your mind. You question every choice you make, every word you say. You often blame yourself, thinking you could have done something different or that somehow you provoked it. ?Logic? often doesn?t work here. If you happen to know someone in an abusive relationship, as much as you want to, you can?t make them leave. As hard and as frustrating as it is, they must leave when they are ready. What you can do is provide them with love, encouragement and support. And let them know that love should never hurt. Ever.

Bankrupt U.S. battery maker A123 Systems Inc. (NASDAQ: AONE) today got permission from the U.S. Bankruptcy Court to use $15.5 million of ?debtor-in-possession? financing from a total of $72.5 million in financing from Johnson Controls Inc. (NYSE: JCI). Johnson has offered to pay $125 million for A123?s automotive business.
That ?stalking horse? bid looks appears to be in the sights of Chinese auto parts maker Wanxiang Group, which said that the company intends to bid at auction for A123. Wanxiang also will contest Johnson?s position as the stalking horse bidder for A123. According to a report from Reuters, Wanxiang appeared in bankruptcy court with its own proposal for debtor-in-possession financing, but the judge ruled that Johnson?s loan was acceptable on an interim basis. The court will rule on the stalking horse bids on October 30th.
The Chinese firm had tried to put together a $465 million deal that would have saved A123 from bankruptcy, but was unable to do so because the battery maker could not meet some relatively low lending hurdles.
A123 has received a $249 million grant from the federal government, of which about half remains unspent. The fate of the unspent funds remains unclear, no matter which firm wins an auction for A123. If Wanxiang wins, the sale will be subject to review by the Committee for Foreign Investment in the U.S. (CFIUS).
Shares of A123 are up 64% today at $0.123, in a 52-week range of $0.05 to $3.91. More than 46 million shares have changed hands so far today.

Q4 of this year should bring about $120.7 billion in spending on home improvements, according to a Leading Indicator of Remodeling Activity (LIRA) report released today by the Remodeling Futures Program at the Joint Center for Housing Studies of Harvard University.
That represents almost 6% more than the four previous quarters, each of which saw spending of around $114 billion to $115 billion.
It gets better. Spending will jump another 12.1% in Q1 2013 to nearly $129 billion, and soar 16.6% higher in Q2 2013 to $134.2 billion, according to LIRA. That's 21.2% higher than the 2011 low of $110.7 billion.
Peak remodeling occurred between 2006 and 2007, at the height of the economic bubble, with spending between $139 billion and $146 billion.

LIRA credits an improving housing market and record-low interest rates for driving the (predicted) gains in remodeling activity.
Typically, a heavy dose of home improvement accompanies the sale of new and existing residences as new owners settle in.
?Strong growth in sales of existing homes and housing starts, coupled with historically low financing costs, have typically been associated with an upturn in home remodeling activity some months later,? says Kermit Baker, director of the Remodeling Futures Program at the Joint Center. ?While the housing market has faced some unique challenges in recent years, this combination is expected to produce a favorable outlook for home improvement spending over the coming months.?

Meanwhile, CE Pro?s own research indicates that home systems integrators are focusing more and more on the retrofit (remodel) market.
According to the most recent CE Pro statistics, 57% of residential revenues now come from existing homes vs. new construction. As recently as 2006, dealers reported that more of their revenue came from new home construction (52.6%) than from remodeling (47.4%) projects.
The good news in remodeling, not surprisingly, follows rosy numbers in new-home construction.
September 2012 saw the highest number of new housing starts in four years, up 15% over August to a seasonally adjusted annual rate of 872,000. Compared to last September, the number of starts is up 34.8 percent.
Single-family homes account for 69 percent of the new starts in September, up 11 percent to 603,000. That is the highest level for single-family homes since August 2008. Also, it's an increase of 43 percent compared to September 2011. Multi-dwelling units (MDUs) rose 25.1 percent vs. August.
